WHAT DOES EARTH PROCESS PERSONAL DATA FOR?

EARTH processes your personal data in order to provide its services and for its marketing, as well as so that you can provide goods and services to us as a supplier. In particular:
- for the benefit of its services to its customers;
- to contact you regarding our services or the items or services to be supplied by you to us;
- to be able to purchase goods or services from you, whether or not for the benefit of our customers;
- for the purpose of its invoicing and payment of invoices;
- to inform you about news and events.
Foundations
The processing of your personal data must be based on one of the principles of the GDPR. At EARTH, these processing purposes depend on the specific personal data and purposes:
- processing is necessary for the execution of the agreed delivery of goods or services by EARTH to you or from you to us;
- processing takes place on the basis of its legal obligation, such as its tax retention obligation;
- processing is necessary (i) for the pursuit of EARTH’s legitimate interests, such as our marketing, unless you have objected to this on good grounds or (ii) to monitor our evidence and legal position; and/or,
- processing is based on your given consent, unless you have subsequently withdrawn that consent.
Which personal data does EARTH. process?
EARTH generally obtains your personal data because you provide that data to us (by e-mail, telephone, business card, post, etc.), you use our website, LinkedIn or Facebook account or we can view that data in public (online) sources, such as websites and the Trade Register at the Chamber of Commerce. Even if you are not a customer or supplier of EARTH, we may (have to) process personal data. Depending on the type of relationship between EARTH and you, EARTH processes (some of) the following personal data:
your contact details, such as your first and last name, your gender (for the salutation in correspondence to you), your address, your telephone number(s), your e-mail address(es);
your payment details;
your personal data that is contained in the information provided to us or in public sources (such as the Chamber of Commerce) and that we need to provide our services;
data (technical information) that we may process as a result of your visit to our website and social media accounts, such as your IP address.
Cookies

Where does EARTH process your personal data?
Your personal data is stored in various databases. For example in our CRM database. Or if the data is contained in correspondence and documents, such as contracts, quotes and invoices, we store that correspondence and documents in our (paper and/or digital) files. The digital databases are located on different servers, some of which are owned and/or managed by other parties (processors). These processors and their servers are located in the EEA.
How is your personal data secured?
EARTH has appropriate organizational and technical measures to protect your personal data and to prevent misuse. We work outside our company via a VPN connection, which means that our internet connection cannot be traced back and we protect ourselves against malicious hackers on public (Wi-Fi) networks.

How long does EARTH store your personal data
EARTH never stores your personal data for longer than is necessary for the purpose of the processing. Depending on the type of personal data, the processing purpose and the basis(s), EARTH stores your personal data for certain periods:
your contact details for the purpose of its marketing: until you have indicated that you do not wish to receive marketing or you have provided your detailsn has withdrawn consent;
documents relating to invoicing that may contain personal data, for as long as legally necessary (tax retention obligation of 7 years);
correspondence and documents relating to our services provided, as long as this is necessary to prove EARTH’s services (5 years to a maximum of 20 years);
the personal data processed on the basis of cookies is stored for 50 months.
Why does EARTH share certain personal data with third parties?
EARTH only shares certain personal data of yours with third parties if it is legally obliged to do so, this is necessary for the performance of the agreed services, when you have given permission for this and/or for the benefit of its marketing activities. Consider a courier company or WeTransfer to send you documents, for example, our accountant for processing invoices and payments and MailChimp for sending newsletters and invitations. What rights do you have with regard to your personal data?
You have the right to view, modify, transfer or have your personal data deleted (for certain processing purposes). In addition, you have the right to object to the processing of your personal data for certain purposes. For example, every marketing email from us includes the option to unsubscribe from such emails. You can also always withdraw your given consent. You can do this by sending an email to contact@earth-now.com. If you object or withdraw your consent, this may mean that we can no longer provide you with the relevant services.
Finally, you have the option to file a complaint with the Dutch Data Protection Authority if you do not agree with the way in which EARTH handles your personal data.
